EUROPEAN COURT OF HUMAN RIGHTS

Protecting Convention rights before the Strasbourg Court

English home · Contact · Italiano

The firm assesses and prepares applications to the European Court of Human Rights regarding alleged violations of the Convention and its Protocols, including matters arising from civil, administrative, and criminal proceedings concerning human rights.

Seizure, confiscation, and property rights

Particular attention is given to measures affecting property and business assets, including the protection of possessions, proportionality of interference, and procedural safeguards. The review connects the domestic procedural history with the Convention rights engaged by the case.

Specialist case assessment

Work begins with the domestic decisions, key case documents, and a chronology. The alleged violation, relevant case law, and admissibility requirements are assessed before the application is prepared.

Admissibility and deadlines

As a rule, an application to the European Court of Human Rights requires exhaustion of effective domestic remedies and compliance with the four-month time limit running from the relevant final domestic decision. The starting date and requirements must be checked in the individual case, making a timely assessment essential.

The Court’s role

The Strasbourg Court examines compliance with the rights protected by the Convention. It is not a further ordinary appeal on the merits of a domestic dispute. Filing an application does not, by itself, suspend domestic orders.

Scope of assistance

Preliminary document review, identification of Convention issues, preparation of the application form and supporting documents, and management of subsequent procedural stages and communications. Each engagement is defined according to the case and its procedural position.

For an initial assessment, the firm will need the domestic decisions, dates of service or notification, and a chronology of the remedies already pursued.
